أولاً: سياسة الخصوصية
1. المعلومات التي نجمعها
عند تسجيلك أو إجراء عملية شراء عبر تطبيق ماميلي، قد نقوم بجمع المعلومات التالية:
- الاسم الكامل
- رقم الهاتف
- البريد الإلكتروني
- عنوان التوصيل والفوترة
- معلومات متعلقة بالطفل، مثل الاسم وتاريخ الميلاد والجنس، عند الحاجة لتخصيص خدماتنا وتقديم العروض والخدمات والهدايا ذات الصلة
- معلومات الدفع عند إتمام الطلب. لا تقوم ماميلي بتخزين تفاصيل بطاقة الائتمان أو الخصم.
كما قد نجمع معلومات تقنية عامة، بما في ذلك:
- عنوان بروتوكول الإنترنت (IP)
- نوع الجهاز والمتصفح
- الصفحات والأقسام التي تمت زيارتها داخل التطبيق
- بيانات ملفات الارتباط (Cookies) لتحسين تجربة المستخدم
2. كيفية استخدام معلوماتك
نستخدم معلوماتك من أجل:
- معالجة طلباتك وتوصيلها بدقة.
- التواصل معك لتأكيد طلبك أو حل أي مشكلات تتعلق به.
- تحسين تجربتك داخل التطبيق وتقديم عروض قد تكون ذات صلة بك.
- إرسال الإشعارات أو العروض الترويجية أو الرسائل التسويقية بموافقتك المسبقة.
3. حماية معلوماتك
نستخدم تدابير أمنية مناسبة، بما في ذلك تشفير SSL، للمساعدة في حماية معلوماتك الشخصية من الوصول غير المصرح به.
تتم معالجة معلومات الدفع فقط عبر مزوّدي خدمات الدفع الإلكتروني المعتمدين والآمنين. ولا تقوم ماميلي بتخزين تفاصيل بطاقتك الائتمانية أو بطاقة الخصم على خوادمها.
4. مشاركة المعلومات
نشارك معلوماتك فقط مع جهات موثوقة عند الضرورة لتقديم خدماتنا وإتمام طلباتك، بما في ذلك:
- شركات الشحن والتوصيل
- مزوّدو خدمات الدفع الإلكتروني
- فرق الدعم الفني وخدمة العملاء لدينا
لا نبيع معلوماتك الشخصية ولا نؤجرها لأطراف ثالثة.
ومع ذلك، قد نكشف عن معلومات معينة عند الاقتضاء بموجب القانون، للامتثال للالتزامات القانونية، أو لحماية أمن وحقوق مستخدمينا، أو لمساعدة الجهات المختصة في إنفاذ القوانين المعمول بها.
5. ملفات الارتباط (Cookies)
يستخدم تطبيق ماميلي ملفات الارتباط لتخصيص تجربة المستخدم والاحتفاظ مؤقتاً بالمعلومات المتعلقة بتسجيل الدخول.
يمكنك إدارة ملفات الارتباط أو تعطيلها من خلال إعدادات المتصفح أو الجهاز. يُرجى ملاحظة أن تعطيل ملفات الارتباط قد يؤثر على بعض وظائف التطبيق، بما في ذلك تسجيل الدخول وميزات الشراء.
6. حقوق المستخدم
يجوز للمستخدمين:
- الوصول إلى معلوماتهم الشخصية أو تحديثها.
- طلب حذف بياناتهم الشخصية من أنظمتنا، وفقاً للمتطلبات القانونية والتشغيلية المعمول بها.
- إلغاء الاشتراك في الإشعارات والرسائل التسويقية في أي وقت.

ثانياً: سياسات العملاء والمتجر
1. استلام الطلب وفحصه
تنويه مهم: يُطلب من العملاء فحص الطلب والتحقق منه بحضور مندوب التوصيل.
بعد مغادرة مندوب التوصيل، لا تتحمل ماميلي المسؤولية عن أي نقص أو مشكلات في الطلب لم يتم الإبلاغ عنها وقت التسليم.
2. الإرجاع
إذا لم تكن راضياً عن منتج ما، يمكنك إرجاعه فوراً إلى مندوب التوصيل عند التسليم.
في هذه الحالة، تُحتسب رسوم التوصيل المطبقة فقط، دون أي رسوم إرجاع إضافية.
3. سياسة الضمان
أي جهاز يتم شراؤه عبر تطبيق ماميلي ومشمول بالضمان تكون مدة ضمانه سنة واحدة على الأقل، وتشمل الصيانة أو الاستبدال في حال وجود عيب مصنعي، وفقاً لما يقدمه المصنّع أو المورّد المعني.
يمكن للعملاء التواصل مع ماميلي لترتيب استلام الجهاز من قبل مندوب التوصيل لغرض الفحص. رسوم النقل هي:
- داخل بغداد: 3,000 دينار عراقي
- أطراف بغداد والمحافظات الأخرى: 5,000 دينار عراقي
إذا أكد الفحص وجود عيب مصنعي، تتحمل الشركة المعنية تكاليف التوصيل كاملة بالإضافة إلى إصلاح المشكلة أو حلها.
تستغرق عملية الفحص والصيانة عادةً حوالي 5–7 أيام من تاريخ استلام الجهاز من مندوب التوصيل.
4. إرشادات استخدام الأجهزة
- يجب شحن الجهاز بالكامل قبل الاستخدام الأول.
- يُنصح العملاء بالاحتفاظ بجميع القطع والإكسسوارات الأصلية.
- يجب عدم غسل الأجهزة أو إساءة استخدامها. ولا يشمل الضمان الكسر أو التلف الناتج عن سوء الاستخدام.
- يجب استخدام رأس شاحن أصلي فقط مع الكابل المرفق مع الجهاز لتجنب الأعطال أو الأضرار الكهربائية.
- لا يشمل الضمان الأضرار الكهربائية الناتجة عن الشواحن الخارجية أو معدات الشحن غير المتوافقة أو ارتفاعات التيار أو الجهد الزائد.
5. رسوم التوصيل
تُقسَّم رسوم التوصيل إلى ثلاث باقات:
التوصيل الاقتصادي
- بغداد: 3,000 دينار عراقي
- الأطراف والمحافظات الأخرى: 5,000 دينار عراقي
- الوقت التقديري للتوصيل: 48–72 ساعة
التوصيل السريع
- بغداد: 5,000 دينار عراقي
- الأطراف والمحافظات الأخرى: 8,000 دينار عراقي
- الوقت التقديري للتوصيل: خلال 24 ساعة
التوصيل الفوري
- بغداد فقط: 10,000 دينار عراقي
- الوقت التقديري للتوصيل: خلال ساعتين
ثالثاً: الملكية الفكرية والعلامة التجارية
جميع المحتويات المتاحة عبر تطبيق ماميلي، بما في ذلك الشعار والتصاميم والنصوص والصور والبرمجيات والبرمجة والميزات والخدمات، مملوكة للمؤسس مريم فراس النجار، ومحمية بموجب قوانين الملكية الفكرية المعمول بها في الإمارات العربية المتحدة وجمهورية العراق.
لا يجوز نسخ أي جزء من المنصة أو محتواها أو إعادة إنتاجه أو توزيعه أو تعديله أو استخدامه دون إذن خطي مسبق.
رابعاً: التعديلات على هذه السياسة
تحتفظ ماميلي بالحق في تعديل هذه السياسة أو تحديثها عند الحاجة لتعكس التغييرات في القوانين أو اللوائح المعمول بها أو ممارسات العمل أو تحسينات خدماتها.
سيتم الإعلان عن أي تحديثات جوهرية داخل التطبيق، مع تاريخ سريان السياسة المعدّلة.

First: Privacy Policy
1. Information We Collect
When you register or make a purchase through the Momily application, we may collect the following information:
- Full name
- Phone number
- Email address
- Delivery and billing address
- Child-related information, such as name, date of birth, and gender, when necessary to personalize our services and provide relevant offers, services, and gifts
- Payment information when completing an order. Credit or debit card details are not stored by Momily.
We may also collect general technical information, including:
- IP address
- Device and browser type
- Pages and sections visited within the application
- Cookie data to improve the user experience
2. How We Use Your Information
We use your information to:
- Process and deliver your orders accurately.
- Contact you to confirm your order or resolve any issues related to it.
- Improve your experience within the application and provide offers that may be relevant to you.
- Send notifications, promotional offers, or marketing communications with your prior consent.
3. Protection of Your Information
We use appropriate security measures, including SSL encryption, to help protect your personal information from unauthorized access.
Payment information is processed only through authorized and secure electronic payment service providers. Momily does not store your credit or debit card details on its servers.
4. Sharing of Information
We share your information only with trusted parties when necessary to provide our services and complete your orders, including:
- Shipping and delivery companies
- Electronic payment service providers
- Our technical support and customer service teams
We do not sell or rent your personal information to third parties.
However, we may disclose certain information when required by law, to comply with legal obligations, protect the security and rights of our users, or assist competent authorities in enforcing applicable laws.
5. Cookies
Momily uses cookies to personalize the user experience and temporarily retain login-related information.
You may manage or disable cookies through your browser or device settings. Please note that disabling cookies may affect certain functions of the application, including login and purchasing features.
6. User Rights
Users may:
- Access or update their personal information.
- Request the deletion of their personal data from our systems, subject to applicable legal and operational requirements.
- Unsubscribe from notifications and marketing communications at any time.

Second: Customer and Store Policies
1. Order Receipt and Inspection
Important Notice: Customers are required to inspect and verify their order while the delivery representative is present.
After the delivery representative has left, Momily shall not be responsible for any missing items or issues with the order that were not reported at the time of delivery.
2. Returns
If you are not satisfied with a product, you may return it immediately to the delivery representative at the time of delivery.
In such cases, only the applicable delivery fee will be charged, with no additional return fees.
3. Warranty Policy
Any device purchased through the Momily application that is covered by a warranty shall have a warranty period of at least one year, covering maintenance or replacement in the event of a manufacturing defect, as provided by the relevant manufacturer or supplier.
Customers may contact Momily to arrange for the device to be collected by a delivery representative for inspection. Transportation fees are:
- Within Baghdad: IQD 3,000
- Outskirts of Baghdad and other governorates: IQD 5,000
If the inspection confirms a manufacturing defect, the relevant company shall cover the full delivery costs in addition to repairing or resolving the issue.
Inspection and maintenance generally take approximately 5–7 days from the date the device is received by the delivery representative.
4. Device Usage Instructions
- The device must be fully charged before first use.
- Customers should retain all original parts and accessories.
- Devices should not be washed or misused. The warranty does not cover breakage or damage resulting from improper use.
- Only an original charging adapter should be used with the cable supplied with the device to prevent electrical faults or damage.
- The warranty does not cover electrical damage caused by third-party chargers, incompatible charging equipment, power surges, or excessive voltage.
5. Delivery Fees
Delivery fees are divided into three packages:
Economy Delivery
- Baghdad: IQD 3,000
- Outskirts and other governorates: IQD 5,000
- Estimated delivery time: 48–72 hours
Express Delivery
- Baghdad: IQD 5,000
- Outskirts and other governorates: IQD 8,000
- Estimated delivery time: within 24 hours
Immediate Delivery
- Baghdad only: IQD 10,000
- Estimated delivery time: within 2 hours
Third: Intellectual Property and Trademark
All content available through the Momily application, including its logo, designs, text, images, software, programming, features, and services, is owned by the founder, Maryam Firas Al-Najjar, and is protected under the applicable intellectual property laws of the United Arab Emirates and the Republic of Iraq.
No part of the platform or its content may be copied, reproduced, distributed, modified, or used without prior written authorization.
Fourth: Amendments to This Policy
Momily reserves the right to amend or update this policy when necessary to reflect changes in applicable laws, regulations, business practices, or improvements to its services.
Any material updates will be announced within the application, together with the effective date of the revised policy.
